Welcome to IXA Studios. By using our website, services, or engaging with any content produced or distributed by IXA Studios, you agree to the following Terms & Conditions. Please read carefully, as they are legally binding.
1. Scope of Services
IXA Studios provides a range of creative services including but not limited to photography, website development, graphic design, digital marketing, and content creation. These terms apply to all services, media, and content produced by IXA Studios, including images, designs, video, web assets, and written content—whether delivered digitally or physically.
2. Intellectual Property & Copyright
All content produced by IXA Studios, including but not limited to photography, video, design files, websites, ad campaigns, and brand materials, remain the property of IXA Studios unless explicitly transferred in writing.
Clients receive usage rights upon final payment. These rights allow you to use the deliverables for their intended purpose (e.g., marketing, publishing, resale, personal use). IXA Studios retains the right to showcase any work for portfolio, marketing, or promotional purposes unless otherwise agreed upon in writing.
Unauthorized reproduction, distribution, or modification of any IXA Studios content is strictly prohibited.
3. Booking, Deposits & Payment Terms
A non-refundable deposit of 50% is required to secure any project or session date. This deposit applies toward your final balance, with the remainder due upon project completion unless otherwise specified in your contract.
Once a contract is signed, the deposit is strictly non-refundable. This is due to the significant amount of time and preparation invested prior to any actual session or design delivery.
If a client cancels before signing a contract:

A partial refund of the deposit may be issued, up to 90%, based on the amount of preparation completed.

If extensive planning, research, or prep work has been done, part or all of the deposit may be retained at the discretion of IXA Studios.
4. Rescheduling & Cancellations
Each client is allowed one complimentary reschedule if made at least 48 hours in advance.

Rescheduling with 24–48 hours' notice will incur a $25 rescheduling fee.

Rescheduling with less than 24 hours’ notice will incur a $100 rescheduling fee.

Missed appointments without notice are treated as a cancellation and may result in forfeiture of the deposit.
Cancellations made after a contract has been signed will result in the loss of the deposit.
5. Revisions & Final Delivery
Most services include one round of revisions unless otherwise noted. Additional revisions may be requested but will incur an extra fee based on the complexity and scope of the request.
Final deliverables will be sent in agreed-upon formats. Timeline for delivery varies by project type and will be communicated clearly during the contract stage. IXA Studios reserves the right to adjust timelines due to workload, holidays, or external delays, with notice.
6. Liability & Risk
While IXA Studios takes all reasonable precautions to protect client content, equipment, and deliverables, we are not liable for:

Technical failures (e.g., memory card corruption, website crashes, or file loss) beyond our control.

Weather, traffic, acts of God, or unexpected incidents during event coverage.

Injuries or accidents caused by unsafe environments, negligence, or misconduct by clients or third parties.
Clients are expected to behave respectfully during sessions or collaborative projects. IXA Studios reserves the right to end a session or project if the environment becomes unsafe or inappropriate.
7. Working with Minors
Clients must be 18 years or older to book services. If the subject is a minor under 18, a parent or legal guardian must provide written consent and be present or aware during the session or project. IXA Studios follows all applicable Kansas and federal laws related to photographing or working with minors.
8. Website Usage & Content
All images, text, logos, and media on the IXA Studios website are protected by copyright and may not be used, reproduced, or distributed without explicit permission.
Use of the website does not grant ownership or license to any content.
9. Policy Updates
IXA Studios reserves the right to update or modify these Terms & Conditions at any time. Continued use of our services or website indicates your acceptance of any changes.
